Common questions
Which states require pay stubs?
Most of them. Only eight states โ Alabama, Arkansas, Florida, Georgia, Louisiana, Mississippi, South Dakota, and Tennessee โ have no pay stub law at all. Kansas requires one when the employee asks. Every other state requires an itemized statement, and states like California and New York spell out the exact fields.
Is there a federal pay stub law?
No federal law requires employers to give pay stubs. The Fair Labor Standards Act requires employers to keep payroll records, which is why most employers issue stubs even in states that do not require them.
